Proview Technology and Apple's iPad trademark disputes have been further fermented. Proview Technology applied to the court in Shanghai yesterday and demanded that the Apple iPad be subject to a ban on sales.
At present, Proview Technology and Apple have played in many regions in China. In June 2010, Apple filed a lawsuit in Shenzhen to confirm that it was the exclusive right holder of the trademark in question. At the end of 2011, the verdict was rejected by Apple. Then Apple appealed and the case is still in the process of hearing. Since then, Proview has sued Apple's two distributors in Shenzhen and Huizhou, sued Apple's direct-operated stores in Shanghai, and used Beijing's Trade and Industry Bureau in Beijing to impose fines on Apple.
According to media reports, in June of last year, the Beijing Administration for Industry and Commerce set a ceiling price of 240 million yuan, but the fine has not yet entered the enforcement process.
Ma Xiaodong, a lawyer representing Proview Technologies, said yesterday that Proview sued Apple in Shanghai and that the main action for the prosecution was to apply for a court order.
Ma Xiaodong said that under normal circumstances, the court will make a decision after 48 hours of receiving an application, whether it will issue a ban.
